right to own a Pet ( dog ) , can a society formed by the owners members disallow ?

i am the only owner member having a pet in my 25 flats apartment. i need to defend my case at the nxt general body meeting . is it within the purview of the present executive members to raise such a question. my dog is a traind Lab , 19 months old. m this is india specific. the society was formed by the owner members without any covenants in respect to pets. my one is a trained Lab and well behaved . what next?

  1. If the covenants for your association prohibit pets, you're out of luck. If the dog is presenting a nuisance that violates the covenants, you're out of luck. Read up on the rules for your complex.
  2. I am not an attorney, but I believe if you are renting an apartment, the owner has a right to refuse to allow pets. If this is some type of condominium owner's association they may have a board that develops regulations that everyone must adhere to. Since living conditions are so close, it is normal to have by-laws that everyone must follow. Things like when you must take out trash, what type of ornamentation can be in view of others on doors, where to park, even whether or not guests, children, and pets are allowed. A lab is a large dog, it may be their concern that it is loud, or may dirty the appartment. Your best bet might be to demonstrate the training and agree to limits on the dog's time in public areas, or guarantee payment for damage.
  3. You have right to own a pet in your apartment unless and until nobody is getting harmed in your society.

If the covenents of your association say that members are allowed to pass rules and the association choises to pass a rule saying you cannont have dogs/pets/pets over a certin size they can do so. However if they do not apply a grandfather clause which states owners that have pets prior to the rule can keep them (even if it states they cannot aquire new ones) they you have pretty good grounds to fight them in court if needed. Just make sure you have plenty of documantation (vet records, akc registration, paper work from city dog licenses ect) that you ownend the dog before the rule was in place
  5. A group ot tenants or a landlord or a homeowners association certainly has a right to make rules about keeping pets, especially large dogs. Are there any written rules or covenants for your apartments? Do you have a written lease? What do the rules say? When you meet with the board, here are some things you might point out (so long as they are true) - you pick up all dog waste and properly dispose of it - your dog rarely barks and then only briefly if someone comes to the door. He doesn't bark at random strangers in the area or bark for no reason or for long periods of time - the dog is obedience trained and you have paperwork to prove - the dog is exercised regularly away from the property and is not destructive - the dog is friendly and does not pose a threat of any kind These are the kind of issues that often concern people about dogs on a property

  7. OK in India no society can prevent you from keeping dogs as pets.... 1. If you are staying on rent then thats a problem. 2. If you own the house.. then just go to BSPCA or the local animal authorities and let them know of your problem and they will sort it out... NOTE : I know the problem that you are going through because I faced this same thing in my society... Believe me if you go to the authorities they will solve it in a jiffy... YOU HAVE A RIGHT TO OWN A DOG AT LEAST U HAVE A WELL BEHAVED ONE... I HAVE 2 CRAZY BOXERS AND 1 GREAT DANE AND 1 SCARY ROTTWEILER... SO BEST OF LUCK
